The Oireachtas Committee on the 8th Amendment has voted that the amendment should not be retained in full in the constitution.
In the first vote by the committee after weeks of hearings, 15 members voted yes, 3 voted no and 2 abstained.
They will now have to recommend one of six possible options to be put to the people by referendum.
They include a simple repeal of the 8th amendment and a proposal to repeal and replace with a new law.
