Court to rule on negligence case against Oxegen

An IT worker who claims he broke his ankle after getting stuck in the mud at Oxegen will find out today if he's won an action for damages against the festival promoters.

Mark Ponisi of Roselawn, Tipper Road in Naas, Co Kildare is suing MCD in the High Court.

He was watching Kings of Leon at the 2007 Oxegen festival when he claims he was thrown violently to the ground.

He alleges that his feet got stuck in mud and that he was unable to move during a crowd surge.

He claims that the ground surface was unsafe but festival promoters MCD deny negligence and say they exercised all reasonable care.

Ms Justice Mary Irvine will rule on the case this morning.
