Decision on Sean Fitzpatrick trial due tomorrow

The High Court will decide tomorrow whether Sean Fitzpatrick’s criminal trial, set for October, can go ahead.

Lawyers for the former Anglo chairman are seeking to overturn a decision in the circuit court earlier this month not to postpone the trial.

Counsel for Mr Fitzpatrick said he was seeking an injunction against the Director of Public Prosecutions to prohibit or restrain his client’s continued prosecution.

Reporting restrictions have been placed on the hearing in the High Court today.

The 66 year old, with an address at Whitshed Road in Greystones denies 27 charges including making misleading, false or deceptive statements and furnishing false information between 2002 and 2007.

Juliette reports from the High Court;

On August 6th – around 3 weeks ago, Judge Martin Nolan in the Circuit Criminal Court rejected an application by lawyers for Mr Fitzpatrick that the trial be postponed.

They had asked that the trial be put off in light of negative publicity surrounding the 66 year old during the trial of three other Anglo officials; Tiarnan O’Mahony, Bernard Daly and Aoife Maguire.

At the time, Judge Nolan said he felt that Mr Fitzpatrick could get a fair trial.

In the HC today, Judge Moriarty said he intended to rule on the application tomorrow, at which time some of the matters that were subject to reporting restrictions might be reported on.
