High Court Urged To Find Dail Strayed Into Judicial Domain

The High Court is being urged to find remarks made in the Dáil about Denis O’Brien’s dealings with the IBRC trespassed into the judicial domain.

The businessman believes the comments shouldn’t have been made while he was challenging the reporting of those details through the courts.

Denis O’Brien claims statements made by Deputies Catherine Murphy and Pearse Doherty affected the outcome of his legal action against RTÉ.

In May 2015, he was granted a temporary order to prevent RTÉ from publishing details of his banking affairs with the IBRC in relation to the purchase of Siteserv three years beforehand.

But once the information was released into the public domain from the floor of the Dáil, he said he was left with no choice but to concede.

He’s accused both of trespassing into the judicial domain in what he contends is a clear breach of the separation of powers, and he wants a declaration to be made to that effect.

He said it was clear from tweets on Deputy Murphy’s account that she knew the reporting restrictions were in place, but chose to disregard them, and is contesting a finding by the Dáil Committee on Procedure and Privileges that she acted in good faith.

The hearing will resume tomorrow.
