HSE to pay €6.5M to 15 year old with Cerebral Palsy

A 15 year old Co Tipperary boy who suffered brain damage at birth is to receive 6.5 million euro in a final legal settlement with the HSE.

Ryan Brennan from Cahir has cerebral palsy and will need lifelong care.

He has been brain damaged since his birth at St Joseph's Hospital in Clonmel in January 2000

In court it was alleged that abnormalities in the foetal heart rate were not acted upon prior to delivery causing a lack of oxygen to the brain resulting in cerebral palsy.

His mother Lorraine sued the HSE on a negligence claim but the case settled without an admission of liability.

Two years ago Ryan received an interim settlement of 1.7 million euro to cover his care costs - today High Court President Nicholas Kearns approved a full and final payment of 6.5 million.

Now aged 15 Ryan attends a special school in Cashel. There are plans for him to go to a day centre when he's 18. He will need care for the rest of his life.
