The terms of reference for the inquiry into the Garda Tapes affair are expected to be agreed this morning.

The Cabinet's expected to discuss the final terms of the inquiry this morning, after deciding whether the inquiry should look into the resignation of the Garda Commissioner, Martin Callinan.

The cabinet's been waiting for an interim report from the acting Garda Commissioner Noirin O'Sullivan before signing off on the final terms of reference.

But it's expected that the final terms for the inquiry, chaired by Supreme Court justice Nial Fennelly, will be discussed at cabinet this morning.

The biggest outstanding question is whether the inquiry will include the circumstances surrouding the departure of Martin Callinan as Garda Commissioner.

There is some reluctance within government circles to allow his resignation to be investigated - as it COULD lead to the conclusion that he WAS effectively sacked.

But with the Oireachtas Justice committee prepared to hold its own investigation otherwise, the issue may be put to Justice Fennelly's inquiry in an attempt to contain the political fallout.
