A hearing date has been provisionally set aside for next month to decide whether the Jobstown protesters should be tried separately.
AAA TD Paul Murphy and 15 others are accused of falsely imprisoning the Tánaiste and her adviser during a water charge protest in November 2014.
The DPP wants to try them in groups of four and five, but their lawyers want to know the reasons for not holding one trial with all of the accused.
