A spokesperson for Dublin solicitor Brian O'Donnell and his wife Mary Patricia say they won't vacate their luxury Killiney home.

They are now facing trespass proceedings after the High Court rejected an attempt by their children to stop a receiver from taking possession of the property, which is being occupied by members of the New Land League.

Under order of the Supreme Court the O'Donnell children were supposed to hand over possession of Gorse Hill on the Vico Road yesterday afternoon to a bank appointed receiver.

But parents Brian and Mary Patricia remain at the 7 million euro property and they have invited in members of the New Land League to join their occupation.

Their spokesperson is John Martin:

Barrister Cian Ferriter, for Bank of Ireland likened the league to 'foot soldiers' and Mr O'Donnell to 'some unfortunate tenant cottier who cannot speak for himself'.

Mr Justice Brian McGovern today ruled that the family's last minute attempt to stop repossession was quite simply 'too late' to raise again issues already decided.

Bank of Ireland say they'll issue trespass proceedings against the O'Donnell parents - the case returns to court on Thursday.
