Alan Shatter has instructed his legal team to appeal the High Court's refusal to quash parts of the Guerin report into the handling of complaints made by Garda whistleblower Maurice McCabe.
The report prompted his resignation as Justice Minister last year.
At a costs hearing today, Mr Shatter's barrister Paul Sreenan said he has instructions to appeal the court's ruling.
Mr Justice Seamus Noonan has awarded costs against the former Minister but put a stay on the order pending an appeal.
